Terms of Service

The terms for using MALKI.

These terms explain the rules that apply when you use the MALKI website, submit a request, access a private tracker, or interact with related services.

Last updated
September 18, 2026

These Terms of Use govern your use of malkistudios.com, its forms, public content, and private MALKI Tracker links. By accessing or using the website, you agree to these terms. If you do not agree, do not use the website.

In these terms, “MALKI,” “we,” “us,” and “our” refer to [full legal business name].

1

Who may use the website

You must be at least 18 years old and able to enter a binding agreement to submit a service request, accept a service agreement, make or authorize payment, or use a private MALKI Tracker on your own behalf.

Clients ages 16–17 may be considered for a MALKI styling or shopping service with the active involvement of a parent or legal guardian. A request for a client under 16 must be started by a parent or legal guardian and is reviewed individually. MALKI may decline a request when the service, circumstances, or available supervision are not an appropriate fit.

For any client under 18, the parent or guardian must submit or approve the request, receive the service details, sign the service agreement, make or authorize payment and shopping funds, approve purchases and final service decisions, remain responsible for communications, and supervise the minor’s use of any private MALKI Tracker. A minor may not independently complete payment, provide merchandise funding, sign an agreement, or approve final items. For purposes of the service agreement and Service and Booking Policy, the parent or guardian is the contracting client.

MALKI Socials are adults-only unless a specific event page expressly states otherwise. An event may also set a higher minimum age.

If you use the website on behalf of a company or another person, you represent that you have authority to bind that party to these terms.

2

The website does not confirm a service or event

The website provides information about MALKI and allows you to express interest, submit a request, or follow a link to an outside registration platform.

Submitting a form is not a confirmed booking. A MALKI service is confirmed only after MALKI accepts the request, the required agreement is completed, and the required payment is received. Events are subject to the availability, eligibility, payment, and event-specific terms shown on the applicable registration platform.

MALKI may ask for more information, recommend a different service, place a request on a waitlist, or decline a request when the timing, scope, location, safety, or fit is not workable.

3

Service agreements and policies

These website terms are separate from MALKI’s Service and Booking Policy and from any signed service agreement, service order, event terms, venue rules, or media release.

If there is a conflict about a particular service, the following order controls unless the signed agreement states otherwise:

  • the signed service agreement or service order;
  • the Service and Booking Policy accepted for that service; and
  • these Terms of Use.
4

Pricing and payment information

Public prices are introductory prices unless stated otherwise and may change for future requests. A change to a public price does not alter a service fee already confirmed in a signed agreement, unless you approve a change in scope or another written adjustment.

Clothing, accessories, taxes, shipping, travel, parking, tolls, delivery, courier service, returns, event tickets, venue charges, and other third-party costs are separate from MALKI’s service fee unless expressly included in writing.

Payments are processed through Stripe or another approved payment provider. Your use of a payment provider is also subject to that provider’s terms and privacy practices.

5

Private MALKI Tracker links

A tracker link is private and limited to the request for which it was issued. You agree to:

  • keep the link confidential;
  • use it only for its intended request;
  • avoid publishing, forwarding, scraping, or attempting to alter it;
  • notify MALKI promptly if you believe the link has been exposed or misused; and
  • access only information you are authorized to view.

MALKI may revoke or replace a tracker link at any time to protect the client, the service, or the system.

6

Accurate information and client materials

You agree to provide information that is accurate and reasonably complete, including dates, sizing, budgets, delivery details, retailer restrictions, accessibility needs, and other facts that may affect a request. MALKI is not responsible for delay, additional cost, or an unsuitable result caused by materially incomplete or inaccurate information.

You retain ownership of photographs, documents, messages, and other materials you provide. You give MALKI a limited permission to use, copy, adapt, store, and share those materials only as reasonably needed to review the request, provide the service, administer the relationship, protect the parties, or comply with law.

You represent that you have the right to provide the materials and that MALKI’s authorized use of them will not violate another person’s rights. Public use of your name, image, testimonial, or story requires a separate permission or media release.

7

MALKI content and intellectual property

The website and its original content—including text, graphics, photographs, videos, designs, logos, service names, page layouts, and other brand materials—are owned by or licensed to MALKI and are protected by applicable intellectual-property laws.

MALKI grants you a limited, revocable, non-exclusive, non-transferable right to use the website and any released client deliverables for your personal, non-commercial use. You may not reproduce, republish, sell, license, distribute, remove attribution from, or create a commercial product from MALKI content without written permission.

You may share a personal shopping link or look reference with a retailer or service provider when reasonably necessary to use the deliverable for its intended purpose. This does not transfer ownership of MALKI’s format, presentation, or underlying materials.

8

Acceptable use

You may not:

  • use the website for unlawful, fraudulent, threatening, harassing, or harmful activity;
  • interfere with the website, introduce malicious code, test vulnerabilities without permission, or bypass access controls;
  • scrape, harvest, or extract website, client, event, or contact information through automated means;
  • impersonate another person or submit information without authority;
  • access another person’s tracker, request, files, or communications;
  • use MALKI content to train, benchmark, or supply an automated system without written permission; or
  • use the website in a way that infringes intellectual-property, privacy, publicity, or other rights.

MALKI may restrict or terminate access when it reasonably believes these terms, a law, or another person’s rights have been violated.

9

Third-party products, services, and links

The website may link to retailers, payment processors, event platforms, venues, couriers, social platforms, or other third parties. Those services are not controlled by MALKI and are governed by their own terms, policies, inventory, pricing, return rules, and accessibility practices.

A link, product reference, or recommendation does not guarantee availability, authenticity, fit, quality, delivery timing, return eligibility, or a particular experience. MALKI is not the manufacturer, seller, venue, or carrier unless expressly stated.

10

Information and availability

MALKI aims to keep public information accurate and current, but availability, prices, schedules, product details, event details, and third-party information may change. Website content is provided for general information and does not replace the confirmed scope in a signed agreement or the current terms shown by a third-party provider.

MALKI may change, suspend, or discontinue any page, feature, service description, or public offer at any time. MALKI is not obligated to accept every request or continue offering a particular service.

11

No guarantee of a particular result

Style, fit, comfort, taste, social experience, retailer performance, and event outcomes are personal and may be affected by factors outside MALKI’s control. MALKI will provide the agreed work with reasonable care but does not guarantee that an item will remain available, that a third party will perform as expected, that every product will fit, or that a service or event will produce a particular personal, professional, social, or financial result.

12

Disclaimer

To the fullest extent permitted by law, the website is provided “as is” and “as available.” MALKI disclaims warranties not expressly stated in a signed agreement, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Nothing in these terms excludes a warranty, duty, or right that cannot legally be excluded.

13

Limitation of liability

To the fullest extent permitted by law, MALKI will not be liable for indirect, incidental, special, exemplary, consequential, or punitive damages, or for loss of profits, data, goodwill, opportunity, or enjoyment arising from use of the website or reliance on third-party content.

To the fullest extent permitted by law, MALKI’s total liability arising from the website will not exceed the greater of (a) the amount you paid MALKI for the specific service giving rise to the claim during the six months before the event or (b) one hundred U.S. dollars. This limitation does not apply where liability cannot be limited by law or where a signed service agreement expressly provides otherwise.

14

Your responsibility for misuse

To the fullest extent permitted by law, you agree to be responsible for reasonable losses, claims, and expenses arising from your unlawful use of the website, your material violation of these terms, or materials you provide without the necessary rights. This section does not require you to cover a loss caused by MALKI’s own unlawful conduct.

15

Privacy

MALKI’s Privacy Policy explains how personal information is collected, used, disclosed, and protected. By using the website, you acknowledge that policy.

16

Governing law and disputes

These terms are governed by the laws of [State], without regard to conflict-of-law rules. Any court proceeding arising from these terms or the website must be brought in the state or federal courts located in [County, State], and each party consents to that location, except where applicable consumer law requires otherwise.

Before filing a claim, you and MALKI agree to make a good-faith effort to resolve the issue through written notice sent to [legal email]. Nothing in this section prevents either party from seeking urgent relief to protect safety, confidential information, or intellectual-property rights.

17

Changes to these terms

MALKI may update these terms as the website, services, or law changes. The revised terms will be posted with a new “Last updated” date. Changes apply prospectively unless law requires otherwise. Your continued use of the website after an update means you accept the revised terms.

18

General terms

If a provision is found unenforceable, the remaining provisions remain in effect. A delay in enforcing a provision is not a waiver. You may not transfer your rights under these terms without MALKI’s written permission. MALKI may transfer these terms as part of a business reorganization, financing, or sale.

These terms, together with the Privacy Policy and any other terms expressly incorporated, are the complete agreement concerning use of the website.
